The purchase of products through our Site is strictly limited to parties who can lawfully enter into and form contracts on the Internet. PONY International reserves the right to only accept orders from those over 18 years old.
By making an offer to purchase our products, you expressly authorize us to perform credit checks and where we deem necessary, to transmit or to obtain information about you to or from third parties, including but not limited to your credit/debit card number and credit reports, in order to authenticate your identity, to validate your credit/debit card, to obtain an initial credit/debit card authorization and to authorize individual purchase transactions.
We may use a third party payment processor to process credit card transactions made through our Site. You are also responsible for paying any government taxes imposed in connection with the usage of our Site or the purchase of any products or services made available through our Site.
PONY International reserves the right to restrict multiple quantities of any item being shipped to any one customer. All orders are subject to acceptance and availability, and the items in your shopping basket are not reserved and may be purchased by other customers. We will not be held liable to you or any third party by reason of our withdrawal of any merchandise from our Site or refusal to process a transaction or unwinding or suspending any transaction after processing has begun.
We offer free standard shipping on all Hong Kong orders. Currently, we do not ship internationally.
You may need your own Site account to use certain services, and you will be required to provide your personal details and have a valid payment method associated with it. When you register, you are required to provide information about yourself that is true, accurate, current, and complete in all respects. Also, you confirm that you are the person referred to in the billing information provided. We may also change registration requirements from time to time. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password.
If you are under 18 years old, you may use the Site only with involvement of a parent or guardian. We reserve the right to refuse service, terminate accounts, terminate your rights to use our Site, remove or edit content, or cancel orders in our sole discretion.
You must notify us immediately of any breach of security or unauthorized use of your account. We shall not be responsible for, and disclaim all liability in connection with, the use of any information that you post or display on our Site. If we determine, in our absolute discretion, that you have engaged in prohibited activities, were disrespectful to other users, or otherwise violated the Terms of Service, we may deny your access to this Site on a temporary or permanent basis and any decision to do so is final.
When you visit our Site, or send e-mails and other communications from your computer or mobile device to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, mobile push notices, or notices and messages on this Site, and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement and that such communications be in writing.
PONY International reserves the right to store a record of your transactions for a minimum of one year. We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service. In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction from you. If you elect to proceed with a transaction that involves the use of services from a third party service provider, your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
Once you leave our Site or are redirected to a third-party website or application, you are no longer governed by our Site’s Terms of Service.
The products available on our Site are described and presented with as much precision as possible. You must read the description of each product in order to know the specifications. The choice and purchase of a product shall be your sole responsibility. However, should there be an error or omission in the information provided by us, we shall not be held responsible. You are invited to inform us of any error that can be found in a product description and we will do our best to publish information that is accurate. If a product offered by us is not as described, your sole remedy is to return it in unused condition in accordance with our Return & Exchange Policy.
Prices shown on the Site are in Hong Kong Dollars (“HKD”) by default. From time to time, prices are subject to change in response to currency exchange rate changes, markdowns and other commercial factors. The price applicable to your order will be the price current at the time your order is accepted. If you are a customer whose credit/debit card is not denominated in HKD, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction.
Once you have made your choice and placed your order, you will receive an email acknowledging your order. The email is NOT an acceptance of your order, but only a confirmation we have received. Unless you cancel your order, acceptance of your order and the contract between you and us will be completed when we email you to confirm dispatch of your order. Neither our third party payment processor nor our nominated courier has the authority to accept an order on behalf of PONY International.
We reserve the right to reject your order in the event that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular product, that the product ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within the Terms of Service.
We may also refuse to process and accept a transaction for any reason and at any time at our sole discretion. We will not be liable to you or any third party for withdrawing any products from the Site whether or not that product has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
Payment can be made by Visa, MasterCard, American Express, or PayPal. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to PONY International, we will not be liable for any delay or non-delivery of your ordered product(s).
For online payments made by credit card, the “Secure Sockets Layer” (SSL) security system is used, which allows for the encryption of your banking information when on the network. We take reasonable care, in so far as reasonably possible within our means, to keep the details of your order and payment secure. But absent negligence on our part, we are not liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from our Site.
Shipping & Tracking
All purchases of products from PONY International are made pursuant to a shipment contract. Title in the product(s) passes to you upon delivery of the product(s) to the carrier/courier. This means that we are not responsible for any event(s) that occur(s) after such title has passed, including wrongful delivery, damage or loss. You are responsible for all costs, including but not restricted to applicable taxes, relating to the import process, if applicable.
When your order ships, you will receive a shipping confirmation email with a link to track your package. The estimated delivery date is only a reference, and does not serve as a guarantee as to when the product can be expected to be delivered.
We may provide promotional codes offering a discount on our products. Promotional codes are non-transferable and cannot be exchanged for cash. Furthermore, they cannot be used in conjunction with any other promotional code or offers, and must be used by the date published, if any. We reserve the right to retract and/or change the terms of our promotional codes at any time and without prior notice.
Return & Exchange
For regular priced products, if, for any reason, you are not satisfied with your order, you may return the product to us for a full refund or exchange within 14 days from the date of receipt. We will only accept products that are in new, unworn, unwashed, unaltered and undamaged conditions. Products must be returned with all tags still attached and intact and must be in their original packaging such as shoe boxes and shoe bags. Products cannot be returned or exchanged after 14 days from the date of receipt. Please get in touch with us at email@example.com for information on the return shipping address and what to include in the package.
You will be responsible for paying the relevant shipping costs for returning your product. Shipping costs you have paid for your order are strictly non-refundable. Only regular priced items may be refunded. Sale items cannot be refunded. As we are not liable for any damages inflicted on the products during shipping, as well as for products which go missing during transit, in order to minimize your losses, we advise that you: (1) Pack the products with sufficient protection; (2) obtain proof of postage; (3) use a trackable shipping service; and (4) purchase shipping insurance
We also do not guarantee that we will receive or accept your returned product in any event. We reserve the right to refuse the return or exchange of a product in case the returned product does not arrive in the conditions indicated in our Returns policy.
Once we receive your package, we will process your refund within 5 business days. Refunds will be made in the same way the original payment was made. For example, if a credit card was used, then that card will be credited with a refund. While we process refunds within 5 business days from the day we received the items, card refunds may take up to 10 business days or longer, for your bank to complete, depending on their processing time.
If you wish to exchange your order, please reach out to us at firstname.lastname@example.org and let us know what product you would like instead. We will send out your desired product as soon as we have received your original product. If the value of the new purchase is greater than the original, you will need to pay for the difference. If the value of the new product is less than the original, we will refund the difference.
You will need to pay for the shipping costs of the new product.
